General Terms and Conditions for the Use of the Personalized Email Sending Service „Sheet2Mail”


Preamble

Sheet2Mail is a personalized email sending service implemented by Linkensphere Kft.

Regular users can send personalized emails by registering on the Sheet2Mail website.

The personalized email sending service is operating 24 hours a day.

Sheet2Mail operates on a pay-as-you-go pricing model. The first 1000 emails are free of charge, and any additional emails are billed based on the pricing available at sheet2mail.com/pricing. Using the Sheet2Mail service entitles the User to send personalized emails directly through the Sheet2Mail platform. The usage will generate an invoice/bill based on the number of emails sent and the applicable pricing.

In order to use the Sheet2Mail service, Users have to register on the website sheet2mail.com.

The document of General Terms and Conditions (hereinafter GTC) contains the conditions for using the Sheet2Mail service. The GTC forms an integral part of the Sheet2Mail service agreement concluded between the Provider of Sheet2Mail service and the User of Sheet2Mail service.


I. Definition of terms


The terms used in General Terms and Conditions are defined as the following:

  1. Web platform: the online interface for accessing the Sheet2Mail service. The components of the web platform include the user dashboard, email sending interface, and account management tools.
  2. Sheet2Mail service: a personalized email sending service with a unique design, allowing users to send customized emails to multiple recipients.
  3. Provider: Linkensphere Kft.

  4. User: A natural or legal person who is concluding the service agreement with the Provider.
  5. Sheet2Mail service: operates on a pay-as-you-go pricing model. The first 1000 emails are free of charge, and any additional emails are billed based on the pricing available at sheet2mail.com/pricing.
  6. Customer Support: Email support available for the Users or those interested in the service to get information about the functioning of the service, register issues, and as a result, steps are taken to resolve any technical problems and any kind of issues reported. Email: [email protected]


II. Scope of the GTC


This document on General Terms and Conditions (GTC) contains the conditions for using the Sheet2Mail service. GTC forms an integral part of the Sheet2Mail service agreement concluded between the Sheet2Mail User and the Provider. The User is accepting these terms and conditions of use by registering in the system on the Sheet2Mail website.

Persons under the age of 18 are not entitled to conclude a service agreement.

The present GTC shall remain in effect for an indefinite term starting on 17. December 2024. The Provider is entitled to amend the GTC and its annexes; such modifications also apply to the contracts effective at the time of the amendment. Potential amendments are announced 10 days before the amendments come into effect, and will enter into force when published on the website. In case the User does not wish to acknowledge the amending provisions of the GTC, then he/she is obliged to cancel the Sheet2Mail account within 10 days from the announcement date of the amendment published on the website. Failure to cancel the account is regarded as acknowledgment of the amended GTC.


III. Service

The Service provides a platform for sending personalized emails based on data sources provided by the User. The Service acts as a data processor, processing the User's data solely for the purpose of delivering personalized emails. The User remains the data controller and is responsible for ensuring that all data processing activities, including obtaining necessary consents, comply with applicable data protection laws and regulations.

The User warrants that they have obtained all necessary consents from individuals to whom they send emails, particularly in cases involving natural persons. The User must be able to provide proof of such consent upon request, especially when inquiries arise from authorities. The Service does not collect personal data about the recipients of the emails. Any statistics or metrics collected by the Service regarding email delivery, opens, and clicks are aggregated and anonymized, ensuring the privacy of individuals.

The Service implements appropriate technical and organizational measures to protect the security and confidentiality of the User's data. This includes measures to prevent unauthorized access, disclosure, alteration, or destruction of data. The Service retains User data for a reasonable period to fulfill the purpose of the Service, comply with legal obligations, and resolve disputes. Upon termination of the Service or at the User's request, the Service will delete or anonymize the User's data, subject to applicable legal requirements.

The User may choose to send emails using either their own email provider or through the SMTP service provided by Sheet2Mail or its third-party partners. The User is solely responsible for ensuring that the chosen method complies with all applicable laws and regulations, including but not limited to anti-spam laws and data protection regulations. Sheet2Mail shall not be liable for any damages or losses arising from the User's use of either method.


III.1. Account

Sheet2Mail accounts shall in each case be registered on the website. The Sheet2Mail account entitles the User to use the personalized email sending service. The User is obliged to accept the terms when concluding the service agreement.

In order to register a Sheet2Mail account, the Provider will require the following data from the User as a natural person / legal entity:

- name or business name

- billing address

- Tax number / VAT number / EU VAT - only for legal entities

- email address.

The User may not transfer the balance on his/her Sheet2Mail account neither partially nor full amount on the account of other accounts.
Your Sheet2Mail account will remain valid indefinitely unless you choose to close it. Please note that closing your account will result in the deletion of all associated data, except for legally required information such as invoices. You can close your account at any time, provided there are no outstanding payments or obligations associated with it.
If you lose, damage, or otherwise compromise your Sheet2Mail account, you are responsible for any resulting consequences. You should immediately report any such incident to our customer support team.
Please note that you are solely responsible for the security and use of your account. Any unauthorized use of your account, whether intentional or accidental, will be your responsibility.


III.1.1. Account users

Sheet2Mail account is a service plan with a unique identifier, which will entitle the holder of the account to send personalized emails.

The individual who registers the billing account is designated as the primary account owner. Only one individual can hold primary ownership of an account at a time.

The primary account owner may invite additional users to the account. Invited users will assume the role of sub-users.
Sub-users have the authority to create and manage their own personalized email campaigns within the account. They can access their own campaigns and add data sources.
Primary owners retain visibility into all campaigns and data sources within the account, including those created by sub-users.

Data sources can be shared across the account, granting all users, both primary owners and sub-users, access to the shared data sources and insights into campaigns targeted to those data sources. The primary account owner is responsible for monitoring the usage of the Service by all sub-users associated with the account.

III.1.2. Fees paid for Sheet2Mail account

Accounts with no payment methods accordingly may send no more than 1000 personalized emails any given month time.To send more than 1000 emails, a valid payment method must be added to the account.

Only accounts with valid payment methods can send more than 1000 emails in a month.

Invoices will be issued on the same day of each month as the User's account creation date, which is referred to as the billing cycle day. Free quotas are reset on billing cycle day


III.1.3. Payments

Online credit card and other payment methods are handled through Barion's system. No credit card or other payment details are passed to the merchant. The service provider Barion Payment Zrt. is an institution supervised by the National Bank of Hungary, licence number H-EN-I-1064/2013.


III.2. Information for the User

  1. The Provider of electronic communication services may charge for the use of the Internet, mobile or other electronic connection (mobile phone, fixed line, PC with Internet connection, tablet with Internet connection) or for a special method of payment based on the specific or other type of contract. The provider of payment services may also charge fees for the use of their services when paying for the services by the Provider. The provider of the service will not charge any additional fees.


III.3. Provisions on termination of the contract for all Users

  1. The Provider is entitled to terminate the contract without prior notice and without imposing a period for rectification if the User or any third party to whom the User has provided the Sheet2Mail account violates the provisions of the present GTC. In case of termination, the User or the person authorized by the User to use the service must stop the use of the service immediately. The Provider is entitled claim the amount in excess of the balance from the User through legal means. 
  2. In case of termination of the contract, the Provider is entitled to refuse entering into a new contract with the User and to inform the customer support. Such a decision solely depends on the decision of the Provider.
  3. The User has the right to terminate the contract at any time. Withdrawal from the contract results in the obligation of the User to cancel the Sheet2Mail account on the website. As a result of the User’s withdrawal from the contract, the Provider will cancel the validity of the Sheet2Mail account.

IV. Rules applicable to use of the Sheet2Mail service

  1. The User is obliged to use the Sheet2Mail service pursuant to the provisions stipulated in the present document about General Terms and Conditions.
  2. The User is obliged to use the Sheet2Mail service in compliance with the applicable laws and regulations in a professional manner.
  3. The User shall only send emails to individuals who have explicitly consented to receive such emails. The User acknowledges that sending unsolicited emails or spam is strictly prohibited and may result in the termination of the User's account.
  4. The User is obliged to protect the service from unauthorized access, loss or any kind of damage, and is obliged to act generally expected in that particular situation in order to avoid these situations.
  5. The User cannot make any modifications to the service.
  6. The User is obliged to report any kind of damage, unauthorized access or technical issues caused by the service by email to the customer support.

V. Responsibility for damage

The User shall be solely responsible for any damages or losses incurred by Sheet2Mail or third parties as a result of the User's misuse of the Service, violation of these Terms, or any illegal or harmful activity conducted through the Service. The User shall indemnify and hold harmless Linkensphere Kft. and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with the User's use of the Service.  


VI. Miscellaneous Provisions

  1. With respect to issues not regulated in the present General Terms and Conditions, the provisions of the relevant legal regulations of the Hungary shall apply.
